What should be included in a Foreclosure referral? Foreclosure referrals should include the following: current reinstatement and payoffs, social security number of all mortgagors, property address, mailing address, type of loan (FHA, VA, CONV), company name that the foreclosure should be held in, copies of default letters that have been sent out, and a copy of the deed of trust (if one is available). What should be included in a Bankruptcy referral? Bankruptcy referrals should include the following: arrearage breakdown, principal balance, interest rate, recorded deed of trust, services requested (motion, proof of claim, objection), and bankruptcy case number. Also, in some cases a copy of the Note is needed, depending on the trustee. A reinstatement is the amount that is to be paid to your mortgage company in order to bring your loan current. It is based on your loan delinquency and other unpaid fees and costs associated with your loan. Why is my payoff more than the original loan? Payoff includes fees and costs you incurred after the inception of your original loan, which may be due to late charges, non-payment, etc. Why do I owe so much if I just came out of bankruptcy? Fees and costs associated with filing a bankruptcy may be still outstanding. If you filed a Chapter 13 and failed to keep your bankruptcy payments current, these amounts would also be due.
